Terms & Conditions

Welcome to the SFBB Pro application (“the App”). If you continue to download, access, or use this App, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our Privacy Notice govern Guardstar Limited’s relationship with you in relation to the App.

If you disagree with any part of these terms and conditions, please do not use the App.

The term “Guardstar Limited”, “GSL”, “we”, “us” or “our” refers to the owner and provider of the App.
The term “you” refers to the user of the App.

SFBB Pro is provided by Guardstar Limited (GSL), Company Registration Number 16290560.

1. About SFBB Pro

SFBB Pro is a digital application designed to support food businesses in the management of food safety documentation and procedures.

The App, associated materials, website content, and support services are provided in English. Language translation may be available. Certain features, services, or materials may not be available outside the UK, as detailed on our website.

2. Acceptance of These Terms

By downloading, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions, together with our Privacy Notice and any applicable app store rules.

If you do not agree to these terms, you must not use the App.

Nothing in these terms affects any statutory rights you may have which cannot be excluded or limited under applicable law.

3. Eligibility and Authority

By using the App, you confirm that:

  • You are at least 18 years of age; and

  • You have the legal capacity to enter into this agreement; and

  • Where you are acting on behalf of a business, you have authority to bind that business.

4. Licence and Subscription

Upon payment of a subscription fee we grant you a non-transferable, non-exclusive licence to use the App on your device, subject to these Terms & Conditions, our Privacy Notice, and applicable app store rules. All other rights are reserved.

Introductory offers are available to new customers only.

Any duplicate or unwanted charges resulting from a failure to cancel an app subscription will not be refunded.

 

5. Legal and Regulatory Information

SFBB Pro includes © Crown copyright material from “Safer Food, Better Business, known as SFBB” (Food Standards Agency, reviewed April 2024, as amended), used under the Open Government Licence v3.

The Food Standards Agency is not affiliated with, and does not endorse, SFBB Pro, Guardstar Limited, or the App.

We will periodically provide App updates free of charge and will incorporate updates to the Food Standards Agency’s “SFBB for Caterers” (English version) within four months of publication.

It is your responsibility to ensure that you are using the most up-to-date version of the App.

SFBB Pro is intended as a support tool only and is not a substitute for legal requirements or professional advice. Compliance with food safety legislation remains the responsibility of the food business proprietor.

6. External Guidance on Food Safety Regulations

Further information can be found at:

Users outside these territories are responsible for obtaining appropriate legal guidance.

We do not act as a duty holder for any statutory or legal obligations applicable to your business.

7. Digital Content and Consumer Rights

The App is supplied as digital content. Nothing in these terms excludes or limits your rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.

Where required by law, you are entitled to remedies in respect of digital content that is not of satisfactory quality, fit for purpose, or as described.

8. Liability

To the fullest extent permitted by law, we exclude all liability for loss or damage arising from the use of the App in relation to food safety or other statutory duties.

Our maximum aggregate liability, whether in contract, tort (including negligence), or otherwise, shall be limited to the value of the last monthly subscription fee paid, or the equivalent monthly licence fee on a pro-rata basis.

We shall not be liable for loss of profit, loss of business, business interruption, or loss of business opportunity, whether direct or indirect.

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any liability which cannot lawfully be excluded.

9. Availability and Changes

We do not guarantee uninterrupted availability of the App or the retention of data. We may suspend, modify, or withdraw the App or these terms at any time.

If the App is permanently withdrawn, you may be entitled to a pro-rata refund for services paid for but not received, capped at the value of the last monthly subscription fee paid.

We are not liable for failure or delay caused by events beyond our reasonable control.

10. Data Storage

Data stored within the App will normally be retained for three years, after which it may be permanently deleted. You will receive at least one month’s notice prior to deletion.

We reserve the right to access stored data where reasonably necessary to assess compliance with these terms.

11. Termination

We reserve the right to terminate access to the App without notice and without refund where there is a material or persistent breach of these terms.

12. Assignment

We may assign or transfer our rights and obligations under these terms at any time. You may not do so without our prior written consent.

13. General

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

A failure by us to enforce any right shall not constitute a waiver of that right.

No third party has any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce these terms.

14. Governing Law

Your use of the App and any dispute arising out of such use is governed by English law, and the courts of England shall have exclusive jurisdiction.
